the federal constitution requires that my client, caught with a piece of crack equivalent to 1/10 of a packet of sweet and low, receive free representation in his criminal appeal, in which the only issues are (1) whether he should receive an additional 75 days of time credit against a sentence he has in fact already completed and (2) whether a $200 fine was properly assessed against him. the federal constitution apparently does not require that he receive free representation in the immigration case that will deport him for possessing that tiny piece of crack back to Cambodia, a country he has not lived in since childhood. I understand that cocaine base represents a grave threat to the American polity, but this does seem a bit backwards.

your roommate could always be worse

“In October 2006 Campbell moved in with Christian Kepler and agreed to pay him rent. On the morning of December 23, 2006, as Kepler was preparing to leave his bedroom, Campbell blocked the doorway. Campbell was angry with Kepler for insisting Campbell still owed him $ 500 in unpaid rent. Kepler largely ignored Campbell’s extended rant about the rent; and, after two hours, Campbell announced he was going to leave. Kepler replied he did not want Campbell in the house and told him not to come back. Campbell left the house; Kepler shut and locked the front door.

Moments later Kepler heard a noise. Looking through a kitchen window, Kepler saw Campbell moving around on the driveway near Kepler’s car, screaming he was going to kill Kepler. Kepler entered the garage from the kitchen and opened the garage door. Campbell ran into the garage and picked up an ax. He began circling Kepler’s car while striking it with the ax. Campbell then told Kepler to notify the police because Campbell was going to kill him. As Kepler watched, Campbell continued to yell and to swing the ax against the car. After several more minutes, Campbell raised the ax and approached Kepler. Kepler ran back into the kitchen and struggled to close the door to the garage as Campbell banged the ax against it.

After securing the door, Kepler telephoned police. Campbell stopped banging on the door to the kitchen, broke a front window (presumably with the ax) and entered the house. Kepler retrieved the ax from the floor and ordered Campbell to leave. Using profanity, Campbell said he would return to kill Kepler; he then left the house through the broken window. Police arrived and arrested Campbell about 100 yards from the house.”

Also: Campbell is the son of that Glen Campbell.

the roommate helpfully informed me that as the cameraman for this video, he actually owns the copyright on it, despite the fact that I own the ipod it was shot on, am the only person in the video, telling a story I own the rights to, and handed the ipod to him and told him to shoot.  the perils of rooming with a copyright lawyer.  he graciously allowed me to post it, however.

on the occasion of “independence”

I looked for an appropriate old This American Life to listen to while I showered this morning, and found Sarah Vowell’s episode on the Trail of Tears. It was a good episode for my frame of mind this Fourth, that is, deep ambivalence about the idea of America and any claim for exceptionalism we might have. Something she said struck me, though: the ratification of the most dastardly of the treaties with the Cherokee passed the Senate by only a single vote.  We tend to think of the worst parts of our history as embodying a monolithic past group of Americans who didn’t know any better. I appreciate reminders that in fact behind every historical atrocity is usually a set of people in the right who lost a political struggle. All I think you can really hope for is to be living in a time where the better angels of our nature are ascendant.
